Orientierungssatz

: 1. Das in einer letztwilligen Verfügung enthaltene Vermächtnis hinsichtlich eines „Sparguthabens“ ist dahingehend auszulegen, dass es sich nicht auf ein Girokonto, sondern auf ein Festgeldkonto erstreckt.

: 2. Der unter der auflösenden Bedingung der Rückübertragung eines zu Lebzeiten zugewendeten Grundstücks an den Erblasser (hier: nach dem Tod des begünstigten Abkömmlings) erklärte Pflichtteilsverzicht wird bei Eintritt der Bedingung unwirksam.
