Leitsatz

: Das Gericht kann sich gemäß § 242 BGB nicht auf ein Erlöschen des Vergütungsanspruchs nach § 2 Satz 1 VBVG berufen, wenn es dem Berufsnachlasspfleger zur Einreichung des Vergütungsantrages zuvor eine Frist von drei Monaten nach Aufhebung der Nachlasspflegschaft eingeräumt hat.
