Orientierungssatz

: Das Rechtsschutzinteresse an der Feststellung der Wirksamkeit der Einsetzung eines Testamentsvollstreckers ist gegeben, da der Testamentsvollstrecker im Fall der Nachlassinsolvenz aufgrund des Prozessführungsrechts im Passivprozess (§ 2213 BGB) neben den Erben eine Forderung im Prüfungstermin nach § 178 Abs. 1 InsO bestreiten und damit die Zwangsvollstreckung aus der Eintragung in die Tabelle gemäß § 201 Abs. 1 InsO verhindern kann.
