Leitsatz

: Ist der Verjährungsbeginn kenntnisabhängig, kommt es für Beginn und Lauf der Verjährung im Falle des Gläubigerwechsels – gleich aus welchem Rechtsgrund – zunächst auf den Kenntnisstand des ursprünglichen Gläubigers an. Hatte dieser die für den Verjährungsbeginn erforderliche Kenntnis, geht der Anspruch so, d.h. mit in Gang gesetzter Verjährung auf den Rechtsnachfolger über, selbst wenn dieser die Kenntnis nicht mit oder erst nach dem Übergang des Anspruchs auf ihn erhält.
