Leitsatz

: Wer nach dem Tod des Rentenempfängers über eine zu Unrecht gezahlte Rente verfügt, ist zur Rückzahlung verpflichtet, auch wenn er die Beerdigungskosten übernommen hat. Eine solche Rentenzahlung fällt nicht in den Nachlass des Verstorbenen.
