Orientierungssatz

: Eine Haftung des Notars wegen behaupteter pflichtwidriger Untätigkeit im Hinblick auf die Fertigstellung eines Entwurfs für eine letzwillige Verfügung kommt wegen überwiegenden Mitverschuldens seiner Mandanten (hier: Erblasser und dessen zu begünstigende Ehefrau) nicht in Betracht, wenn die Mandanten nicht mehr ernsthaft davon ausgehen konnten, dass der Notar noch für sie tätig würde und wenn darüber hinaus auch ausreichend Zeit vor dem Erbfall bestand, einen anderen Notar zu beauftragen.
